COMMON PROBLEMS IN BEAUTY AND WELLNESS

The problems that bring beauty and wellness businesses to us

The treatment side of this sector is regulated unevenly, so what is lawful often depends on who is carrying out the procedure and what is being injected rather than on what the treatment is called. These are the six situations we are asked about most, and what each one turns on.

Clients are often surprised how much of this rests on professional regulation rather than statute. It still decides whether a treatment can be offered at all, and by whom.

A treatment involves a prescription-only medicine Botulinum toxin is prescription only, so it can be prescribed only by a doctor, a dentist or an independent prescriber, and every relevant regulator now prohibits remote prescribing of injectable cosmetic medicines. That is professional regulation rather than statute, and it decides who can lawfully offer the treatment.
A client is under 18 Administering botulinum toxin or a subcutaneous filler for cosmetic purposes to someone under eighteen in England is an offence under the Botulinum Toxin and Cosmetic Fillers (Children) Act 2021, as is arranging or booking it, unless a doctor has approved the treatment.
Licensing is coming and the model is not ready The power to license non-surgical cosmetic procedures in England sits in the Health and Care Act 2022. The government responded to its consultation in 2025, but no scheme is in force and no start date has been set. Local authority special treatment licensing may still apply in the meantime.
A self-employed therapist works on our terms Chair or room rental, who controls pricing and hours, insurance, and who holds the client relationship. Status follows the practice rather than the label, and the client list is usually the thing actually in dispute.
A complaint concerns consent or outcome What was recorded before the treatment, the consent that was taken, and the difference between describing a likely outcome and guaranteeing one.
Client records and images are used in marketing Consent for before and after imagery, special category health data where the treatment is clinical, and what happens to records and images when a therapist leaves.
